Mais la l\u00e9gislation prend fin bient\u00f4t et le travail \u00e0 distance va probablement continuer pour de nombreux Italiens sans qu\u2019il y ait encore de loi mise \u00e0&nbsp;jour.<\/p>\n<p>Le gouvernement italien a donc travaill\u00e9 avec vingt-six organisations syndicales et d\u2019entreprises sur des r\u00e8gles pour 2022, apportant plus de clart\u00e9 sur les conditions de travail pr\u00e9parant le terrain pour une r\u00e9glementation officielle.<\/p>\n<h2>Autonomie dans le smart working&nbsp;: pas d\u2019horaires stricts et droit \u00e0 la d\u00e9connexion<\/h2>\n<p>Le smart working va au-del\u00e0 des concepts de travail \u00e0 domicile ou de t\u00e9l\u00e9travail et vise \u00e0 offrir un meilleur \u00e9quilibre entre vie professionnelle et vie priv\u00e9e ou \u00e0 accro\u00eetre l\u2019agilit\u00e9 dans l\u2019ex\u00e9cution de son travail.<\/p>\n<p>Selon les repr\u00e9sentants italiens, ce travail agile est \u00ab\u202f<em>caract\u00e9ris\u00e9 par <strong>l\u2019absence d\u2019horaires de travail pr\u00e9cis et par l\u2019autonomie<\/strong> dans l\u2019ex\u00e9cution du service dans le cadre des objectifs fix\u00e9s<\/em>\u202f\u00bb. Le t\u00e9l\u00e9travail et le travail \u00e0 domicile n\u2019offrent pas la m\u00eame autonomie en termes d\u2019horaire de travail et\/ou de&nbsp;lieu.<\/p>\n<p>L\u2019accord fournit un cadre, pas encore juridiquement contraignant, dans lequel le travail \u00e0 distance est fourni sur la <strong>base du volontariat et n\u00e9cessite un accord sign\u00e9 pour chaque individu<\/strong>. Le contrat devrait stipuler les modalit\u00e9s entre les jours normaux et les jours de travail en smart working.<\/p>\n<p>De plus, les personnes peuvent changer d\u2019avis et revenir \u00e0 un travail de bureau plus conventionnel. I<strong>ls ne peuvent pas non plus recevoir de bl\u00e2mes, \u00eatre sanctionn\u00e9s ou licenci\u00e9s s\u2019ils refusent<\/strong> d\u2019adopter le smart working.<\/p>\n<p>Le fait de ne pas avoir d\u2019horaire fixe ou de contraintes de temps pendant ces jours <strong>emp\u00eache \u00e9galement les employ\u00e9s de faire des heures suppl\u00e9mentaires<\/strong> \u2013 et d\u2019\u00eatre pay\u00e9s en plus pour cela \u2013 souligne le protocole.<\/p>\n<p>Mais le mode de travail agile permet malgr\u00e9 tout d\u2019articuler le travail selon des <strong>plages horaires d\u00e9finis<\/strong>. Toutefois, les employ\u00e9s ont le droit de se d\u00e9connecter et les <strong>cr\u00e9neaux horaires d\u00e9di\u00e9s doivent de ce fait \u00eatre clairement identifi\u00e9s<\/strong>.<\/p>\n<h2>Les entreprises fournissent le mat\u00e9riel de travail<\/h2>\n<p><!--more--><\/p>\n<p>Pendant les cong\u00e9s consid\u00e9r\u00e9s comme l\u00e9gitimes, comme les arr\u00eats maladie, les vacances ou les cong\u00e9s pay\u00e9s, les travailleurs ont <strong>le droit \u00e0 la d\u00e9connexion des moyens de communication li\u00e9s au travail<\/strong>, comme les t\u00e9l\u00e9phones ou ordinateurs portables. Mais ils doivent \u00eatre charg\u00e9s et op\u00e9rationnels lorsqu\u2019ils reprennent le travail.<\/p>\n<p>Les employeurs doivent g\u00e9n\u00e9ralement se charger de fournir l\u2019\u00e9quipement appropri\u00e9 pour le travail, mais <strong>un accord peut permettre aux employ\u00e9s d\u2019utiliser leurs propres appareils<\/strong>. Dans ce cas, les travailleurs peuvent <strong>\u00eatre indemnis\u00e9s pour l\u2019utilisation de leur propre \u00e9quipement<\/strong>. Mais les employ\u00e9s sont responsables des dommages caus\u00e9s aux outils de travail s\u2019ils r\u00e9sultent de comportements n\u00e9gligents de leur&nbsp;part.<\/p>\n<h2>Un lieu de travail flexible mais des entreprises responsables de la s\u00e9curit\u00e9 de leurs employ\u00e9s<\/h2>\n<p>Les personnes sont libres d\u2019identifier les lieux de travail qu\u2019elles souhaitent, pour autant qu\u2019ils soient adapt\u00e9s \u00e0 leur travail et conformes aux <strong>conditions de s\u00e9curit\u00e9 personnelle et de confidentialit\u00e9<\/strong>, y compris le traitement des donn\u00e9es, de l\u2019entreprise. Certains lieux peuvent \u00eatre interdits dans le contrat s\u2019ils ne r\u00e9pondent pas \u00e0 ces exigences.<\/p>\n<p>En effet, <strong>les employeurs restent responsables de la s\u00e9curit\u00e9 et de la sant\u00e9 de leurs collaborateurs <\/strong>dans l\u2019exercice de leurs fonctions, m\u00eame s\u2019ils ne sont pas au bureau. Le travailleur agile a alors droit \u00e0 une protection contre les accidents du travail et les maladies professionnelles. Il conserve les m\u00eames droits en mati\u00e8re de formation et de possibilit\u00e9s de carri\u00e8re.<\/p>\n<p>Le protocole pour les employ\u00e9s du secteur public a d\u00e9j\u00e0 \u00e9t\u00e9 convenu il y a quelques semaines. Et les directives pr\u00e9sentent quelques diff\u00e9rences.<\/p>\n<p>Par exemple, <a href=\"https:\/\/video.sky.it\/news\/politica\/video\/smart-working-ecco-le-regole-per-la-p-a-703557\">le smart working interdit aux fonctionnaires<\/a> d\u2019utiliser leur r\u00e9seau Internet personnel pour travailler.
