Spotify estimait que cela justifiait le travail de nuit pour \u00ab\u202fr\u00e9pondre aux besoins sociaux et de service urgents\u202f\u00bb.<\/p>\n<h2>L\u2019exploitation d\u2019un service de streaming audio ne n\u00e9cessite pas de travail de&nbsp;nuit<\/h2>\n<p>Cependant, l\u2019Autorit\u00e9 su\u00e9doise de l\u2019environnement de travail et la Cour d\u2019appel ne sont pas d\u2019accord. Le tribunal a d\u00e9clar\u00e9 que le streaming n\u2019est pas un int\u00e9r\u00eat public important ou un <a href=\"https:\/\/www.newsendip.com\/fr\/le-ministre-allemand-de-la-sante-veut-supprimer-les-gardes-de-nuit-pour-le-personnel-infirmier-dans-les-hopitaux\/\">besoin de service urgent<\/a> qui justifie une exemption \u00e0 l\u2019interdiction du travail de&nbsp;nuit.<\/p>\n<p>L\u2019argument le plus fort pour accorder une exemption \u00e0 Spotify \u00e9tait de pr\u00e9venir les fuites de donn\u00e9es et les menaces de cybers\u00e9curit\u00e9, mais le tribunal a constat\u00e9 que l\u2019entreprise n\u2019a pas prouv\u00e9 que le travail de nuit \u00e9tait le seul moyen de traiter ces probl\u00e8mes. Au lieu de cela, cela semblait principalement li\u00e9 \u00e0 la limitation des perturbations op\u00e9rationnelles dans son service de streaming audio, une raison commerciale plus que soci\u00e9tale.<\/p>\n<p>Le travail de nuit est interdit en Su\u00e8de entre minuit et 5 heures du matin pour prot\u00e9ger la sant\u00e9 des travailleurs, avec des exceptions pour les travaux essentiels \u00e0 la soci\u00e9t\u00e9.<\/p>\n<p>Le travail de nuit non couvert par les exemptions peut cependant \u00eatre effectu\u00e9s par le biais d\u2019accords collectifs, que Spotify se refuse d\u2019appliquer.
